Sales and Refunds Policy

This policy sets out the terms and conditions for the sale of services and digital products provided by Omar Saleem Photography. By booking a session or purchasing a product, you agree to these terms in full. Our policies are designed to be fair, transparent, and compliant with the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
1. Service Bookings and Confirmations
All photography sessions, creative writing commissions, and consultations are subject to availability. A booking is only deemed "confirmed" once we have issued a formal booking confirmation and received either the full payment or a specified non-refundable retainer (deposit). Until such time, the date remains available for other potential clients.
2. Pricing and Payments
All prices are quoted in Great British Pounds (GBP). We reserve the right to change our pricing at any time; however, the price quoted at the time of your booking confirmation will be honoured. Payments are accepted via Bank Transfer, PayPal, or major Credit/Debit cards as outlined in our Payment Options section. We do not store financial data; all transactions are encrypted via secure third-party providers.
3. Non-Refundable Retainers (Deposits)
To secure a specific date and time, a retainer is required. This fee covers our administrative costs, pre-shoot preparations, and the loss of opportunity to book other clients for that specific period. In accordance with UK law, this retainer is generally non-refundable should you choose to cancel, as it represents a genuine pre-estimate of our loss of business.
4. Rescheduling and Cancellations
We understand that circumstances can change. Our rescheduling and cancellation policy is as follows:
- Rescheduling: With more than 72 hours' notice, we will endeavour to move your booking to a new date at no extra cost (subject to availability).
- Client Cancellation: Cancellations must be made in writing. If cancelled within 48 hours of the scheduled start time, the full fee may remain payable to cover lost time and preparation.
- Photographer Cancellation: In the highly unlikely event that we must cancel due to illness or emergency, we will offer a full refund of all monies paid or an alternative date.
5. Digital Products and Downloads
In accordance with the Consumer Contracts Regulations, the 14-day "cooling-off" period for digital content (such as digital image files or poetry PDFs) is waived once the download link has been accessed or the files have been delivered. Due to the nature of digital goods, these items are non-refundable once delivered, except in cases where the file is proven to be technically defective.
6. Quality Guarantee and Consumer Rights
We take immense pride in the artistic quality of our work. Under the Consumer Rights Act 2015, services must be provided with "reasonable care and skill." If you feel our service has fallen below this standard, please contact us immediately. Please note that "artistic style" and "creative judgment" are subjective; refunds will not be issued based on a change of mind regarding the artistic direction once the commission has been completed.
7. Refund Processing
Approved refunds will be processed within 14 days of the agreement. All refunds will be issued to the original payment method used at the time of purchase to comply with anti-money laundering regulations and standard financial practices.
8. Force Majeure
Omar Saleem Photography shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to equipment failure, extreme weather, or government-mandated restrictions.
